I live in notrhern virginia and I would like to open up a poker room. I kno most of the laws about "illegal gambling" but would it work if nothing was made from the tables? No charge to play. All profits made by food drinks and alcohol. would that work? Thanks.

Money from food/drink and alcohol... That's called a bar/restaurant... that happens to have poker tables for people to play.

But even if you, as the house don't make any money, it's probably not legal to have people openly gambling in your public establishment.

Now if the people playing poker aren't gambling for real money, then it's probably fine, but what would be the point?

I looked it up just for fun, and in Virginia there is an exception afforded to gambling in private residences, but a bar or restaurant in no way constitutes a private residence.

The fact that you are not taking a rake has no bearing on anything. Even if you could legally run a not-for-profit poker game (which you can't, BTW), any lawyer worth a salt could argue that the poker game increased the establishment's food and drink sales, and therefore generated a profit, even though it was indirect. Either way, you are SOL.

Anyway, if this were in any way legal, there would already be lots of bar or restaurants doing it. Do not think that this idea is in any way original.

Virginia doesn't currently offer legal poker card rooms although the home poker game scene is active. Underground cardrooms and Texas Holdem games are easy to find on the Internet using a search engine, but we always recommend giving online poker a try rather than risking the low levels of security which are sometimes present in illicit gambling environments. Regardless of rake/profit I don't think it's legal but I've never heard of any home poker games getting busted.
